If there is a conflict regarding paid services, the signed service document controls.

2. Services, Assessments, and Quotes
Utah Radon Defense provides radon testing, radon mitigation, system diagnostics and repairs, fan replacement, monitoring, and related services. Website descriptions are general information and do not guarantee that a particular service, schedule, price, or result is available for every property.
- Quotes and recommendations may depend on an on-site assessment, property conditions, testing data, access, and information supplied by the customer.
- Pricing, timing, scope, deposits, payment obligations, warranties, and guarantees are governed by the applicable written proposal or agreement.
- A radon test or mitigation system reduces risk but does not eliminate all risk. Radon levels can change with weather, soil conditions, ventilation, building changes, and other factors. Follow all testing, maintenance, and retesting instructions provided with your service.
3. Customer Responsibilities and Property Access
You represent that you own the property or are authorized to request services. You agree to provide safe, timely access to relevant areas; disclose known hazards, structural issues, utilities, private lines, restricted areas, and prior systems; secure pets; and provide accurate property information. Additional work caused by undisclosed or inaccessible conditions may require a revised scope or price.

Program description. If you voluntarily opt in, Utah Radon Defense may send recurring SMS or MMS messages about inquiries, quotes, appointments, testing or installation scheduling, service and system updates, customer support, reminders, account or membership communications, and promotional offers.
- Consent: SMS consent is voluntary, is not a condition of purchasing goods or services, and must be provided through an optional, unchecked consent control or another valid opt-in method.
- Frequency: Message frequency varies depending on your requests, services, and interactions with us.
- Charges: Message and data rates may apply. Contact your wireless carrier for details about your plan.
- Opt out: Reply STOP to any message to opt out. We may send one final message confirming your opt-out. You may also communicate a clear revocation request through another reasonable method.

Liability relating to paid services is governed by the applicable written service agreement and applicable law. This limitation does not apply where prohibited by law.
10. Indemnification
To the extent permitted by law, you agree to indemnify and hold Utah Radon Defense harmless from third-party claims, losses, or expenses arising from your unlawful misuse of the Website, your violation of these Terms, or inaccurate representations about your authority to request property services.
11. Governing Law and Venue
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Any dispute not governed by a separate signed agreement will be brought in a court of competent jurisdiction in Utah, unless applicable law requires otherwise.
12. Changes; Severability; Entire Agreement
We may update these Terms by posting a revised version and changing the effective date. Changes apply prospectively when posted, unless otherwise stated. If any provision is unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy and any applicable signed service document, constitute the agreement concerning the matters they cover. Our failure to enforce a provision is not a waiver.
